What these terms cover:

These Terms govern all of Scipilot’s services, sites and products, related Support, and Additional Services.


Product-Specific Terms. Our Products may be subject to additional terms specific to that product as set forth in the Product-Specific Terms. By accessing or using a product covered by the Product-Specific Terms, you also agree to the Product-Specific Terms.


1. Terms

By accessing the website at http://scipilot.com.au, or any Scipilot product, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.


2. We reserve the right to suspend or remove access to our products

We do not guarantee that our products, or any content on them, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our products for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.


2. Use Licence

Permission is granted to temporarily download one copy of the Product (information or software) from Scipilot, the Apple app store or Google Play store, or Scipilot product's websites for personal, non-commercial transitory viewing and interaction only. This is the grant of a licence, not a transfer of title, and under this licence the End User must not:


  • copy the Product, reverse engineer, decompile, disassemble, or derive source code from the Product, publish, distribute, rent, lease, sell, sublicense, assign, translate, merge, adapt, reproduce, make error corrections, vary, alter or modify, the whole or any part of the Product nor permit the Product or any part of it to be combined with, or become incorporated in, any other programs;

  • remove or obscure any copyright or proprietary notices on the Product;

  • transfer the materials to another person or "mirror" the materials on any other server.

  • access or use the Product in source code form;



This licence shall automatically terminate if you violate any of these restrictions and may be terminated by Scipilot at any time. Upon terminating your viewing of these materials or upon the termination of this licence, you must destroy any downloaded materials in your possession whether in electronic or printed format.


3. Disclaimer


The materials on Scipilot's website and products are provided on an 'as is' basis. Scipilot makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

Further, Scipilot does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website, products, or otherwise relating to such materials or on any sites linked to this site.


4. Limitations


In no event shall Scipilot or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Scipilot's website or products, even if Scipilot or a Scipilot authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.


5. Accuracy of materials


The materials appearing on Scipilot's website could include technical, typographical, or photographic errors. Scipilot does not warrant that any of the materials on its website are accurate, complete or current. Scipilot may make changes to the materials contained on its website at any time without notice. However Scipilot does not make any commitment to update the materials.


6. Links


Scipilot has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Scipilot of the site. Use of any such linked website is at the user's own risk.


7. Modifications


Scipilot may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.


8. Governing Law


These terms and conditions are governed by and construed in accordance with the laws of NSW, Australia and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.



Syras Specific Terms

9.1 Fees

The Fee for the use of Syras is a voluntary one off payment that upgrades the Project to provide specific features for the duration of that Syras Project. Upgrading a Project will provide the specified features through the lifecycle of the project.


A Screening Lifecycle Event occurs when more than 20% of articles in any article-set have been screened by any of the Project users. After the Screening Lifecycle Event, resetting the project is no longer possible.

Scipilot reserves the right to introduce or change any Fees from time-to-time, as part of adjustments to these terms and conditions.

GST

For Customers in Australia, GST is applicable to any Fees charged by the Company to the User. Unless expressed otherwise, all Fees shall be deemed inclusive of GST.

Refunds

No refunds of Fees are offered other than as required by law or at Scipilot’s absolute discretion.


9.2 Screening Data

Screening Data is the data you upload in order to complete the screening process. It does not include derivative data such as usage configuration data, or product telemetry.


9.3 Your Screening Data responsibilities

You are responsible for the legality, accuracy and completeness of screening data. This includes but is not limited to the suitable formatting for import into Syras. You warrant that all Screening Data you input or import does not infringe on the rights of any third party, and you will be liable to us and indemnify us for any breach of the warranty. You will be responsible for any loss or damage incurred as a result of any breach of warranty.


9.4 Data formats

The data formats supported by Syras are limited to those outlined in the product documentation. It is your responsibility to ensure that the formats offered will meet your needs, prior to purchasing.


9.5 Project Data retention

We do not commit to retaining Project Data for longer than 6 months from the project creation date. If you believe your screening process will require multiple rounds of revision over a period longer than 6 months, we recommend keeping good records of your imported, and project configuration, so you can rebuild a new project if required.


9.6 Your account is yours

You are responsible for your account. Keep the password safe and secure, and do not share it with anyone. Scipilot takes no responsibility for actions resulting from an account that has been compromised.


You also agree not to use your account for the purposes of a service bureau or time share for more than one person’s usage.

Castles and Coltheart Test 2 (CC2) Specific Terms

10.1 Fees

The fee for the CC2 is for the running of a single Test Session. Test Sessions are purchased in packs, providing the number of sessions specified under each pack.


A Test Session allows you to administer the CC2 with a child, and to download the Test Session Report.


GST

For Customers in Australia, GST is applicable to any Fees charged by the Company to the User. Unless expressed otherwise, all Fees shall be deemed inclusive of GST.

Refunds

No refunds of Fees are offered other than as required by law or at Scipilot’s absolute discretion.



10.2 Test Session and Marking

A Test Session is a session between a Qualified Tester/Assessor, and a child. The session lasts from the moment the “View Instructions to get started” button is pressed, until the screen “Well done, you’ve finished the test” screen is displayed.


Marking is the device input that specifies a correct or incorrectly spoken word.


10.3 Your test session responsibilities

You are responsible for following the instructions set out at the beginning of the test.


During the Test Session, you are responsible for accurately judging whether a child successfully or unsuccessfully pronounced a word. You can learn to make a judgement of a spoken word in the “Listen to words” screen. You can learn to enter your judgement as a mark in the “Practise marking” screen.


You are responsible for accurately judging the child, and accurately entering the mark for each spoken word.


Inaccurate judgements cannot be corrected after they have occurred.


10.4 Test Session Reports

The marking from a Test Session is stored locally on your device. A Test Session Report is generated when a Test Session is completed. Scipilot never has access to, nor interacts with the personal data or results from the Test Session run on your device. The Test Session Report can be shared using the operating system capabilities for sharing, and storing the results.


Scipilot is not liable for the loss, damage, or deletion of Test Session Reports on the local device for any reason, including but not limited to device failure, CC2 app software failure, accidental deletion, or device crashes.


10.5 Your Test Session Reporting responsibilities

You are responsible for interpretation and any required communication of the results of the Test Session. An explanation of the z-scores, and percentiles are provided within the report.


You are responsible for any long-term storage of Test Session Reports from each Test Session because the previous Test Session Report will be cleared before a new Test Session can be prepared.


You are solely responsible for the privacy and protection of the personal data for the child, as this is downloaded and shared at your discretion. Scipilot never has access to, nor interacts with the personal data or results from the Test Session run on your device.


10.6 Suitable Qualification to run the CC2

The CC2 is intended to be run by a Qualified Tester/Assessor. You are qualified if you have been trained to administer and interpret the results of reading tests with children. For more details on what this means, view our knowledge base article.


Scipilot is not liable for any resulting outcome from the running of the CC2 by unqualified individuals. This includes misuse of the test, inaccurate or unclear results, and Test Session costs.


10.7 CC2 test design

Any test methodology and limitations of the CC2 are by design by the original test authors, and any changes are at the discretion of the original test authors. View the details for the test at the Macquarie University website.


10.8 Device and Operating System (OS) support

Scipilot maintains the right to change the Devices and Operating Systems supported by the CC2 app without notice to customers.


Scipilot uses a best-effort approach to supporting Devices or Operating System (OS) versions as they age, and as the app evolves over time. As Scipilot stops supporting Devices or OS versions, purchased test sessions that are on the device may be affected, become inaccessible, or even lost.


In the event that you lose access to pre-purchased Test Sessions and have access to the DeviceID of the device that completed the purchase, Scipilot may be able to transfer your unused test sessions to another device. Contact support at support@scipilot.freshdesk.com with the old and new Device ID’s, and we may be able to make the transfer.


Scipilot is not liable for any impact or losses resulting from a change in the Devices or OS’s that are supported, or the lack of support for a given Device or OS.


10.9 CC2 app support

Scipilot provides support via email (support@scipilot.freshdesk.com) and web based service desk and knowledge base (https://scipilot.freshdesk.com/support/home) for customers who have purchased Test Sessions on the CC2 app. Scipilot does not provide telephone support. Please allow 1-2 business days for a response to a support request.


Support is provided for customers whose most recent purchase of Test Sessions is within the last 6 months.


Scipilot retains the right to request proof of purchase for Test Sessions. Scipilot retains the right to reject support requests from customers whose last purchase is more than 6 months prior to the support request.
